Membership Terms and Conditions

The following Terms and Conditions apply if you are or become a Subscriber to any of the subscription packages offered by Versatile Vet Pty Ltd (Versatile Vet). By accessing our Web Site and materials available to you as a Subscriber, or viewing any of our materials available to you as a Subscriber, you agree to be bound by these Terms and Conditions.
Some of the Terms and Conditions here are repeated in the general Terms and Conditions that apply to anyone who uses our Web Site. In the event of any conflict between the general Terms and Conditions, these Membership Terms and Conditions shall take precedence.
- Caution - Veterinary Professionals
- Many of the videos on this website show veterinary skills and procedures that are restricted acts of Veterinary Science and may only be performed by registered veterinarians and in accordance with the relevant State and Federal laws of their country.
- The skills and procedures shown in these videos represent the preferred techniques of the presenting clinician for a particular clinical scenario. In Veterinary Science there are frequently several different techniques or approaches that may be considered for similar clinical presentations. Clinical decision making should be informed by formal veterinary education, clinical experience and the particular presenting case in the context of the State and Federal laws relating to the performance of veterinary services in a particular location.
- Veterinary professionals who use this site should consider their own level of qualifications and experience and seek assistance from experienced colleagues or refer to veterinary specialists rather than attempt any procedure shown on this site that is beyond their level of expertise.
- Subscription
You offer to subscribe by completing and submitting the Account Information, Billing Address and Payment Information above under this tab. If this is validly completed it will constitute an offer to Versatile Vet which will be capable of acceptance by the provision of access to the materials to the nominated user. Versatile Vet may decline an offer in its sole discretion without being obliged to provide a reason for declining.
- Term and Renewal
- The Subscription period shall be for a period of twelve (12) months unless otherwise agreed in writing and shall commence on the date that Versatile Vet provides access.
- Renewal of the Subscription will be subject to payment of the Subscription price for the following period of twelve months. We shall automatically renew your subscription for the following Subscription period after reminding you by email or other means of the renewal. Unless you notify us of your intention to cancel the Subscription in the manner set out in the reminder, we shall then deduct your Subscription price from the credit card that you have nominated for payment of your Subscription fee and we shall continue to do that for each following Subscription renewal until you notify us otherwise in accordance with this clause.
- We may change the Subscription price for any subsequent Subscription period by giving you notice at the time that we remind you of the renewal of the Subscription in accordance with the previous subclause.
- Versatile Vet shall be entitled to suspend or terminate the Subscription at any time during the Subscription Period (as to which see clause 6).
- Payment
The Subscription price shall be payable by the Subscriber in accordance with the Payment Information provided by the Subscriber and access to the materials during the Subscription period or during any renewal of the Subscription period shall at all times be subject to that payment having been made, cleared for payment and not being subject to any refund under the terms of the credit card for which details are provided.
- Access and Use
Upon the commencement of the Subscription, in accordance with these Terms and Conditions, Versatile Vet will grant to the Subscriber for its nominated users a limited, non-exclusive, non-transferable licence to access and to use the materials for the Subscription period. The Subscriber agrees:
- not to download nor to copy reproduce, make available online or electronically transmit, publish, adapt, distribute, transmit, broadcast, display, sell, license, or otherwise exploit in any other way any of the materials;
- not to circumvent, disable or otherwise interfere with security-related features of the Web Site or the materials;
- that a breach of these conditions will entitle Versatile Vet to immediately deny access and/or to terminate the Subscription.
- Termination
Either of us may terminate this agreement at any time and for any reason. If Versatile Vet terminates we shall be entitled to notify you of termination by any reasonable means including by email. Following termination, we may deny you access to the Site and materials available to you as a former Subscriber. If we terminate this agreement, you will not be entitled to a refund of your current or past subscriptions.
- Acceptance of Terms and Conditions
- By using this Web Site and materials available to you as a Subscriber, you agree, without limitation or qualification, to be bound by, and to comply with, these Terms and Conditions and any other posted guidelines or rules applicable to the Web Site and materials available to you as a Subscriber. All such guidelines and rules are hereby incorporated by reference into the Terms and Conditions.
- Versatile Vet may vary or make changes to these Terms and Conditions at any time by sending a notice of the variation or change to the Subscriber. Your continued use of the Subscription and the materials shall be deemed acceptance of the variation or change.
- Privacy Policy
Versatile Vet is subject to the provisions of the Privacy Act 1988. The Act contains 10 National Privacy Principles that set standards for the handling of personal information. Versatile Vet has a commitment to privacy and the safeguarding of personal information. Our Privacy Policy is available for reference on this Web Site.
- Disclaimer
- This Web Site and materials available to you as a Subscriber contain general information, audio and vision about veterinary conditions, procedures and treatments that are specific to the individual cases and situations portrayed. The information is not professional advice, and should not be relied on as such. All content found on this Site and materials available to you as a Subscriber including text, images, audio, or other formats were created for informational purposes only. None of the individual contributors, system operators, developers, sponsors of Versatile Vet, nor anyone else connected to Versatile Vet takes any responsibility for the results or consequences of any attempt to make use of any of the information presented on this Site and materials available to you as a Subscriber. As a convenience to you, Versatile Vet may provide, on this Site and in materials available to you as a Subscriber, links to Web Sites operated by other entities. If you use these Sites you will leave this Web Site. If you decide to visit any linked Site, you do so at your own risk and it is your responsibility to take all protective measures to guard against viruses or other destructive elements. Versatile Vet makes no warranty or representation regarding, and does not endorse, any linked Web Site or the information appearing thereon or any of the products or services described thereon. This Site and materials available to you as a Subscriber contains material which is owned by or licensed to us. Versatile Vet owns or is otherwise entitled to all Intellectual Property rights in the Site and materials available to you as a Subscriber and in the materials, and nothing in these terms and conditions constitutes a transfer of any Intellectual Property rights. Specifically, we own or are entitled to the rights in the copyright which subsists in all creative and literary works displayed in the Site and materials available to you as a Subscriber. Trademarks, service marks, graphics and logos used in connection with the Site and materials available to you as a Subscriber are either ours or the trademarks of their respective owners and may not be copied, imitated or used, in whole or in part, without our prior written permission or the applicable trademark holders’ permission.

Versatile Vet respects your privacy. Our directors, employees, contractors and service providers are required to read this policy and understand their responsibilities when dealing with personal information.

FREQUENTLY ASKED QUESTIONS
We generally do not disclose your personal information to third parties. Exceptions include where we are required to disclose confidential information by force of law, and where the third party agrees only to use or disclose the information as authorised by Versatile Vet.
We never disclose any personal information except in accordance with this policy.
If you do not wish to provide us with all the personal information we request from you, you may do so but we may not have sufficient information to comply with our obligations under various legislation, or our own administrative procedures required for prudent management of Versatile Vet’s operations.
SENSITIVE INFORMATION
We are particularly concerned to deal appropriately with sensitive information. We may ask you to provide us with your personal information when you apply to become a subscriber to any of the products or services offered by Versatile Vet, or if you apply to become an employee of or contractor to Versatile Vet, or make an inquiry, where your personal details are required to fulfil the query, or when you wish to contact us online or via our website.

We will use your personal information to improve our services to subscribers and, if appropriate, to the public:
- where reasonably required to provide anything that Versatile Vet provides to subscribers;

OUR WEBSITE
To ensure we are meeting the needs and wants of our website users, and to develop our online services, we may collect aggregated information using cookies. Cookies will track your use of our web site, and may also be used to compile statistics on visits to the site in an aggregated form and log anonymous information (including metadata) such as:

- the date and time of your visit

When you visit our site a Cookie may be placed on your machine. Where you have visited us before the Cookie may be read each time you re-visit the site.

MARKETING
From time to time, we may advise you of new services and marketing initiatives that we think may be of interest to you. This may include newsletters and general information about Versatile Vet. If you would prefer not to receive such communications from us, please contact our Privacy Officer to be removed from the relevant circulation list. Please note that we may require written confirmation of your request, for example where legislation requires us to provide particular communications to you.
ACCESS TO YOUR PERSONAL INFORMATION
Where we hold your personal information, we will provide you with access if you request. We will try to allow you access in a form and manner suitable to your needs. See also “Restrictions on Access” below.

CORRECTION OF RECORDS
If we hold your personal information and you notify us that it is not accurate, complete or up-to-date, we will take reasonable steps to correct the information in the manner that you have requested. If we consider that the information we retain does not require amendment, we will annotate your request on our files.
RESTRICTIONS ON ACCESS
Where providing access would reveal evaluative information generated within Versatile Vet in connection with a commercially sensitive decision-making process, Versatile Vet may give you an explanation for the decision, rather than direct access to the information.
If we have given you such an explanation and you believe that direct access to the evaluative information is necessary to provide a reasonable explanation of the reasons for the decision, we will, at your request, review the decision. Personnel other than the original decision-maker will conduct the review.
Wherever direct access by you is impractical or inappropriate, we should consider together whether the use of mutually agreed intermediaries would allow sufficient access to meet both our needs.
The Act recognises that there are some situations where it is not appropriate to provide you with access. For example when:
- providing access would pose a serious and imminent threat to the life or health of any individual providing access would have an unreasonable impact upon the privacy of other individuals;
- the request for access is frivolous or vexatious;
- the information relates to an anticipated or existing legal dispute and disclosure would compromise our position.
Should any of the situations arise, you may be denied access.
CHARGES FOR ACCESS
If Versatile Vet levies charges for providing access to personal information, those charges will be reasonable and will not be excessive. We will not charge you for lodging a request for access. We will provide an estimate of charges to you if you ask for it, or if it appears to us that the work will be onerous or otherwise warrants charges.
SECURITY
We are committed to maintaining safeguards to protect personal information against unauthorised use, disclosure, access, alteration, destruction and accidental loss. All personal information we hold is dealt with in accordance with the NPPs and industry standards for the security and protection of information. Your personal information is stored securely and access is restricted to authorised personnel only. Our computer systems require access passwords, and these are kept secure. Internal policies exist on management of personal information and staff and relevant contractors are required to ensure compliance with these policies. All our staff and relevant contractors are required to read this policy and understand their responsibilities in relation to your personal information.
OVERSEAS TRANSFER
We will not transfer your personal information outside Australia unless:
- we reasonably believe that the recipient of the information is subject to legal obligations that uphold principles for the protection and fair handling of personal information that are substantially similar to the principles contained in this policy;
- you give us your consent to do so, expressly or by implication;
- we are contractually required to do so; or
- the transfer is for your benefit and it is not practicable for Versatile Vet to obtain your consent and if you were able to grant consent, you would be likely to give it. In this instance we will advise you to whom your information has been disclosed as soon as practicable.
CHANGES TO OUR POLICY
We may update or change this policy from time to time. When we do so, we will publish the current policy on our web site, and make it available in hard copy on request by contacting our Privacy Officer.

COMPLAINT RESOLUTION
We are committed to constantly improving our procedures so that your personal information is treated appropriately.
If you feel that we have failed to deal with your personal information in accordance with the NPPs or this policy, please speak to us so that we have an opportunity to resolve the issue to your satisfaction.
The person to contact is our Privacy Officer.
Our Privacy Officer will manage the following process for us to:
- listen to your concerns and grievances regarding our handling of your personal information;
- discuss with you the ways in which we can remedy the situation; and
- put in place an action plan to resolve your complaint and improve our information handling procedures if appropriate.
If this process does not result in an outcome that is satisfactory to you, you may contact the Information Commissioner’s Office. We will work together with the Information Commissioner’s Office to resolve the issues between us.
